Dupouy & Méndez, domiciled at Badajoz 45, Piso 17, Las Condes, Santiago, Chile, is responsible for the processing of the personal data you provide to us through this website. This Privacy Policy describes what data we collect, for what purpose we process it, and what your rights are as the data subject.
1. Data we collect and purpose of processing
We collect the personal data you voluntarily provide through this site's contact forms (name, email address, company, phone number, and the content of your message). We process this data solely to respond to your inquiry, to evaluate a potential professional services relationship, and, should that relationship be formalized, for the performance of the corresponding engagement or services contract.
We also collect, through the professional-evaluation request form on the Law 21.719 Implementation page, your full name, company, role, email address, phone number when voluntarily provided, and your preferred contact method. That form also attaches the answers given in the initial readiness check, the preliminary result generated from those answers, an indicator of processing activities that require special attention, the page language, the date and time of submission, and, where available, the referring site and campaign (UTM) parameters. We use this data solely to receive and respond to your assessment request, understand the context of your inquiry, and prepare the corresponding professional follow-up. That initial check is for guidance purposes only: it does not constitute a legal compliance assessment or a complete legal diagnosis.
2. Legal basis for processing
The processing of your data is based on your consent, given by voluntarily submitting the contact form, and on the firm's legitimate interest in evaluating and responding to inquiries directed at the provision of professional services. Where a contractual relationship exists, further processing is based on the performance of that contract and on compliance with the legal obligations arising from it.
3. Data retention and deletion
We retain your personal data for as long as an active contact or services relationship exists. Once that relationship has ended, or at your express request, we delete your data, unless a legal obligation to retain it exists, for example, tax regulations or anti-money laundering rules, in which case we retain it only for the corresponding legal period.
4. Your rights as a data subject
You have the right to:
- Access your personal data and know how it is processed.
- Rectify your data when it is inaccurate, incomplete, or outdated.
- Request the cancellation or deletion of your data, where applicable.
- Object to the processing of your data for justified reasons.
You may exercise these rights by writing to contacto@dmcia.cl, stating your name, the right you wish to exercise, and the information needed to identify you. We will respond to your request within 5 calendar days of receipt, a period we may extend once for up to 5 additional calendar days, notifying you of this before the original period expires.
If you are not satisfied with our response, you may file a complaint with the Agency for the Protection of Personal Data, once that body is operational under Law N° 21.719.
5. Cookies and analytics tools
This site does not use third-party cookies or analytics tools. If we introduce any in the future, we will update this section before activating them.
6. Security measures
We adopt reasonable technical and organizational measures to protect your personal data against unauthorized access, loss, or misuse.
7. Data processors and no transfer of data to third parties
We do not sell or transfer your personal data to third parties for commercial purposes. To process submissions from this site's forms (including the contact form and the assessment request form on the Law 21.719 Implementation page), we use Formspree, Inc., a service provider based in the United States, as a data processor. Formspree receives only the data you voluntarily enter in the relevant form and processes it solely to deliver it to us.
8. Compliance with Law N° 21.719
This Privacy Policy was prepared in accordance with the standards of Law N° 21.719, which Regulates the Protection and Processing of Personal Data and Creates the Agency for the Protection of Personal Data, published in the Official Gazette on December 13, 2024. Although this law will enter into force on December 1, 2026, its requirements are substantially higher than those of the currently applicable regulation, Law N° 19.628. Dupouy & Méndez has chosen to adopt these more demanding standards already in the processing of its clients' and visitors' personal data.
